I'm not sure about that. If he pulled his gun on Martin without just cause, that's a felony in Florida. If he then kills Martin, that makes the homicide murder whether it was intended or not. Manslaughter is reserved for unintended homicides resulting from criminal behavior that doesn't rise to the level of a felony.
