That argument is assinine, IMHO.
Every president belongs to a party, and will pick nominees that most closely align with his philosophies. Why on earth would a sitting POTUS nominate someone who he feels is totally out of alignment with his views?
Not to mention that the nominee has to go before the Senate, and they are definitely going to fillet a nominee who doesn't agree with their philosophies, or those who they just flat out dislike.

We cannot have justices who are nothing more than robed politicians. The decision made regarding WalMart's complete disregard for the labor law set employee rights back 50 years.
