    No it doesn't. The Supreme Court has NEVER held that those clauses guarantee everyone a job. They therefore don't apply.

    For those who wish to have a paycheck and/or other benefits, providing they return a fair share of labor in return, there are cooperatives and other worker-run operations. The trade-off is usually lower pay than capitalist-employers provide. Capitalists are least willing, nor are they as able to provide jobs, as a "right" in that sense.

    Currently, the underemployment rate is well over 15%, and if we speculate on another 10% who have FT jobs but would readily bail out of working in the capitalist sector, that would put the potential collective work force at around 25%. Of course, if enough people make effort to go the cooperative route in order to ensure full employment, it would mean the end of capitalism as we know it.

    Who knows? That might make both the socialist and capitalist portions of our economy more healthy. Capitalists would be competing for labor once again, while socialists would have to offer better conditions to worker-owners to keep them from bolting to a position in the capitalist sector. I was richly rewarded for my work in the socialist sector, as I am partially retired at 53 years of age. While my final average salary was perhaps 25% less than what I could have made in the capistalist sector, my public pension plan was much more secure (and generous with time) than most plans in the for-profit sector.

    It only fails to apply if the high court strikes it down. In our system of law, everything not forbidden is allowed, and nothing in the Constitution forbids it. Until Congress passes a law establishing the right to a job, the SCOTUS can't direct us on the issue.

    Which is perverse, as the language of the Constitution makes it clear that, as far as the Federal government is concerned, what is not allowed is forbidden.

    It isn't forbidden until judicial review says so.
