View Full Version : Judge Blocks TABC From Seizing Porn Unless It's Ruled Obscene

HOUSTON -- The Texas Alcoholic Beverage Commission can't seize adult materials it deems obscene without getting a judge's consent, a federal judge has ruled.

U.S. District Judge Gray Miller said the practice violates the constitutional protection of free speech. He also deemed unconstitutional the law TABC agents were enforcing in seizing the materials.

The Monday ruling came in response to a lawsuit filed in 2003 by Carico Distributing Co., a Houston-based vendor of adult materials. Carico sued to stop TABC raids on convenience and liquor stores distributing its adult magazines, videos and CDs.

"It goes to show the cowboy mentality of the TABC agents," said Michael Lamson, a lawyer for Carico.

The TABC declined comment, as did the Texas Attorney General's Office, which represented the agency in court.

Lamson said the TABC could appeal or wait for the Legislature to rewrite the law.

Miller ordered a permanent injunction stopping the TABC seizures, writing that the agency can seize materials only after a judge determines they are obscene.

"The TABC may not simply designate materials 'obscene,' and then proceed from that untested premise," Miller wrote. "The law demands a judicial determination that this designation is accurate."

Miller also said the state law that forbids the possession or display of "immoral, indecent, lewd or profane" materials by merchants with TABC licenses or permits is unconstitutionally vague.link (http://www.click2houston.com/news/9577366/detail.html)

Shouldn't the TABC have their hands full ... with ... um ... alcohol n stuff :confused:you'd think, but as the article alludes to, those guys are arrogant bastards that think they're god.

In Oklahoma, no alcohol is sold on Sundays, on Election Day, on any holiday under the sun. None after 9 p.m. Bars close at 2 a.m. Beer has half the regular alcohol content. Complete idiocy.

Mississippi used to be just like this. Now, they only stop selling alcohol on election days. Why election days? I have no clue of course.
But, I find it interesting that you have more access to alcohol in MS than Oklahoma. MS used to be the most backwards state in the Union. I guess now it's only in the top 10.

In Kentucky no alcohol is sold on Sundays, but I seem to recall being able to get it at restaraunts. If you go to a grocery or gas station it will be locked up.

You can't sell alcohol on Election Day until after the polls are closed.
