Teacher in Abuse Case Gets Probation

HACKENSACK, N.J. (AP) — Declaring no harm had been done, a judge spared a teacher who admitted having a sexual relationship with a 13-year-old student from prison time.

A state legislator, outraged by the decision, said the judge should be removed from the bench.

Pamela Diehl-Moore, 43, pleaded guilty to sexual assault in January. Prosecutors had expected her to be sentenced to three years in prison.

"We are talking about a sexual assault of a little boy,'' prosecutor Martin Delaney said at Wednesday's sentencing. "We need to send a message to these people that this is unacceptable and you will pay with your liberty.''

But Superior Court Judge Bruce Gaeta disagreed, saying people mature at different rates. He gave Diehl-Moore five years probation.

"It's just something between two people that clicked beyond the teacher-student relationship,'' Gaeta said. "I really don't see the harm that was done and certainly society doesn't need to be worried.''

Republican state Rep. Rose Heck called the sentence ``shocking and unacceptable.''

"Does that mean the he believes there should be no law against adults having sex with minors? If so, I would suggest it is time for this judge to be removed from the bench,'' Heck said Thursday.

The sexual relationship began in 1999 after the boy passed Diehl-Moore's seventh grade class. Authorities said it lasted about six months. According to state law, a 13-year-old cannot legally consent to sexual activity.

Diehl-Moore, a divorcee with two daughters, was arrested last year and has since lost her teaching license. She begged the judge not to separate her from her children.

"I would never hurt anybody,'' she said. "I will never do this again. It was a lapse in judgment.''

Diehl-Moore was also ordered to continue intensive counseling for severe depression.

Well, I don't really see her as a danger to society. Why waste our prison space with her? Save it for the real criminals and those who can do harm to society.

As biased as it is to say this, a teenage male interacting with a n adult female is a lot different than a teenage female interacting with an adult male. Whether this is based on science or just bigotry I'm not completely sure of, but it seems right.

I'm more likely to agree with that, than a prison term.

I don't want my tax dollars paying for another room and board that's of no real danger to the community.

Seems to me she ought to be registered in the local community’s ‘Sex Offender’ lists.
The fact is she should have known better, the 13-year-old couldn’t have been mature enough to make a decision, and since she obviously lured/manipulated one kid means she might well do it again. I see she’s divorced. Unless the dad was an abusive deadbeat, they should send to kids to him to keep them away from her.

If it was a male doing this with a 13 year old girl, I feel the response may of been different??? She is a threat to society, she can't rationalize that fscking a 13 year old boy in her classroom is WRONG she should be tucked away in a little box. The funny thing is this wench is probably a 'model' member of society otherwise.

I agree with Froggy, too. She should be filed away as a sexual offender.

This is the fscked up double standard that pisses me off. A gay teacher is let go of his position for doing his business away FROM students, never having touched a student sexually and now this wacko broad is just given a slap on the wrist.

I agree with you on the male/female double standard, and I made note of this in my first post. However, even if it does appear to be unfair, it does seem to be based on some truth. Do we really think of this woman in the predatory way that we think of her male counterpart? Should we? Is it fair to think of men and women as having some basic biological differences?

I'm not advocating what she did. I do not approve of it, and it is unfortunate that it occurred. However, I don't see her as a threat to society in the same way that a male would be. But of course that's because we all know that men are stronger, smarter, and overall better:D

And just for the record I agree that she should face some legal action, just not a lengthy sentence that would serve no purpose, and I am defending the gay porn teacher. Even if I'm wrong, I'm still consistent.
