This week, the Senate is scheduled to begin debate on the FAIR Act, the latest attempt to reform the monstrosity that is the asbestos litigation system. But is the FAIR Act really the best solution?

that would almost certainly be a $170 billion "oops"

the biggest problem with the bill is that no one knows exactly what's in it other than Specter

What on earth isn't going to be an "oops"? The situation is out of control now.People are dying taking all the diagnostic tests to satisfy the lwayers and accountants...

they still need to take those tests to be eligible for the trust fund

it's also not likely that much of the target $140 billion would be available in the near future. the parties responsible for paying into the trust fund can sue almost endlessly to determine their trust fund liability

The tests aren't the root of the problem.It's an address to the litigation fever the country has had the last few decades...
