Fitzroy Barnaby said he had to swerve to avoid hitting the 14-year-old Des Plaines girl who walked in front of his car.

She said he yelled, "Come here, little girl," before getting out of his car and grabbing her by the arm.

He said he simply lectured her.

She said she broke free and ran, fearful of what he'd do next.

In a Thursday ruling, the Appellate Court of Illinois said the 28-year-old Evanston man must register as a sex offender.

In the criminal case against him, Cook County Judge Patrick Morse said that "it's more likely than not" Barnaby planned only "to chastise the girl" when he grabbed her, but "I can't read his mind."



The above quote is from the article. The judge said "I can't read his mind." He's right; he can't. But that's exactly where the defendant MUST be given the benefit. The prosecution MUST PROVE it's case ... and they admit that they can't. Instead of assuming the worst, they should have acknowledged that the defendant was "innocent until PROVEN guilty" not "innocent until ASSUMED guilty".

BTW, after reading the article, I beleive that he grabbed the girls arm to get her attention so he could chastise her for being a dumb@ss.

It's a real shame he's not black.

Plato said it well ! I don't remember who he was, but he hit the nail on the head . This story is just one more example of in-justice . But this is nothing new . Been going on forever .

It wasn't statutory rape. She had several injuries, which meant a stronger charge. He obviously raped her, but it came down to "he said she said", and the race card + rich/powerful parents trump the fact the girl is from a dirt poor family.

It's a real shame he's not black.
