Court OKs Student's "Straight Pride"

SUMMARY: A judge determined that a high school student was motivated by homophobia to wear a "Straight Pride" sweatshirt but that school administrators do not have the right to stop him.
A Minnesota high school student has won the right to wear a "Straight Pride" sweatshirt to school.
U.S. District Court Judge Donovan Frank's May 17 preliminary injunction said there was a "strong likelihood" Woodbury High School administrators violated Elliot Chambers' free speech rights by forbidding him to wear the shirt to school.
Frank said the motivation behind the 16-year-old's attire appeared to be anti-gay, but there was not enough proof that wearing it would substantially disrupt school activities.
"This is a tremendous victory for student free speech and a small step toward exposing the hypocrisy of the 'tolerance agenda,'" said Stephen Crampton, chief counsel for the American Family Association Center for Law and Policy, according to the Associated Press. The Mississippi-based organization filed the suit in April on Chambers' behalf.
"When the politically correct invoke 'tolerance,' they usually mean tolerance only for those promoting deviant and socially destructive behaviors," said Crampton. "The court recognized that true tolerance means tolerance of all, and not only a select few."
The judge's decision -- which commended the school for attempting to create a tolerant and respectful environment -- said administrators could re-ban the shirt in the future if it did threaten to significantly disrupt school activities.
District and school officials indicated they would accept Frank's ruling.
